These Terms of Service ("Terms") are a binding agreement between you and Lumitale ("Lumitale," "we," "us," or "our") governing your use of the Lumitale app and related services (the "Service"). Please read them carefully. By downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
The Service is operated by and for adults on behalf of children. You must be at least 18 years old (or the age of majority where you live) to accept these Terms, create a family, make purchases, or otherwise operate the Service. By using Lumitale you represent that you are a parent or legal guardian setting it up for, and supervising, any child who uses it, and that you accept these Terms on behalf of yourself and that child. You are responsible for all activity that occurs through your device.
Lumitale lets a child make a few illustrated choices, which are woven by artificial intelligence into a short, age-appropriate storybook with illustrations that you can read together and save. Features, content, and availability may change over time.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the Service for your family's personal, non-commercial enjoyment. You may not copy, modify, distribute, sell, sublicense, reverse engineer, decompile, scrape, or create derivative works of the Service, except as permitted by law.
Stories and illustrations are generated by artificial intelligence based on the choices made in the app. We design Lumitale with strong safety guardrails intended to keep content gentle, kind, and age-appropriate, and we filter and moderate generated output. However, AI systems are not perfect and generated content may occasionally be unexpected, imperfect, or not to your taste. Generated content:

You agree not to: use the Service unlawfully or to harm others; attempt to bypass the parental gate, trial limits, or security; access the Service through automated means; interfere with or overload the Service; misuse our generation systems; or use the Service to create or seek content that is unlawful or that exploits or endangers children. We may suspend or terminate access for violations.
The Service, including its software, design, brand, name, logo, illustration system, and content (other than your story inputs and the books you generate), is owned by us or our licensors and protected by intellectual-property laws. As between you and us, and subject to these Terms and the rights of our providers, you may use the storybooks you generate for your family's personal, non-commercial purposes. Bundled music is licensed under Creative Commons Attribution 3.0 (CC BY 3.0); attribution is provided in the app's Music & Credits page. "Lumitale" and our logos are our trademarks.
Your use of the Service is also governed by our Privacy Policy, which explains how the limited information the app handles is processed. Lumitale is built for children's privacy (COPPA / GDPR-K) with no ads and no third-party tracking.
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT GENERATED CONTENT WILL MEET YOUR EXPECTATIONS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMITALE AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US$50. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT FULLY APPLY TO YOU.
To the extent permitted by law, you agree to indemnify and hold harmless Lumitale and its officers, employees, and suppliers from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service or violation of these Terms.
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive (including ownership, disclaimers, liability limits, indemnification, and dispute resolution) will survive termination.
We may modify or discontinue features, and we may update these Terms. For material changes we will provide notice in the app and update the "Last updated" date. Continued use after changes take effect means you accept the revised Terms.
Please contact us first at hello@lumitaleapp.com so we can try to resolve any concern informally. To the fullest extent permitted by law, any dispute that is not resolved informally will be settled by binding individual arbitration rather than in court, and you and we waive any right to a jury trial or to participate in a class or representative action. You may opt out of arbitration by emailing us within 30 days of first accepting these Terms. Nothing here prevents either party from seeking relief in small-claims court, and these provisions apply only where enforceable; consumers retain any non-waivable rights under local law.
These Terms are governed by the laws of the jurisdiction in which Lumitale is established, without regard to conflict-of-laws rules, except that mandatory consumer-protection laws of your country of residence continue to apply.
These Terms are between you and Lumitale only, not with Apple. Apple is not responsible for the Service or its content. To the extent these Terms conflict with Apple's Media Services Terms for purchases, Apple's terms govern the purchase. You agree:
If any provision is unenforceable, the rest remains in effect. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
